Since the first edition of P Q R Boberg's The Law of Persons and the Family was published in 1977, the law of persons in South Africa has witnessed profound transformations. Legislation introduced since the first edition includes the Divorce Act, Guardianship Act, Child Care Act, Domicile Act and various statutes regulating matrimonial property. The 1996 Constitution came into force and South Africa has also ratified a number of international conventions such as the International Convention on the Rights of the Child, the United Nations Convention on the Elimination of all Forms of Discrimination against Women, and the Hague Convention on Child Abduction. In seeking to make sense of these developments, the book was brought up to date in a manner which reflects these broader changes within legal practice and scholarship.
